NO - As an employer, you have an obligation

As an employer, you have the duty to:

  • obtain a seasonal work permit or a work permit for the foreigner,
  • before s/he starts to work, check the document based on which s/he is legally in Poland and keep its copy in their file,
  • no later than on the day of commencement of work sign a contract with the foreigner (employment or civil law) following the terms of employment indicated in the permit or a declaration on entrusting work to a foreigner,
  • present the foreigner with a translation of their contract in a language, which they do understand,
  • if you already have a work permit, hand over one copy to the foreigner to whom the permit applies - they need it for their application for a national visa (D) for work at the Polish consulate in their country of origin,
  • inform the Governor of the change of employment conditions specified in the work permit,
  • adjust, at least once a year, the amount of remuneration of the foreigner you employ to the current amount of the average monthly wage in the national economy, announced by the President of the Central Statistical Office,
  • exercise due diligence in proceedings for a permit or extension of a work permit.
