New legal provisions on UK nationals and their family members resience rights

From the beginning of 2021, citizens of the United Kingdom and their family members living in Poland will be able to submit applications for new residence documents. New legal provisions have been introduced with the Act of December 10, 2020, amending the Act on entry into the territory of the Republic of Poland, stay and departure from this territory, of citizens of the Member States of the European Union and members of their families (Journal of Laws item 2369). The Act assumes inter alia, solutions enabling Poland to apply the agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the EU in the area of citizens' rights of UK nationals and their family members.

On December 31, 2020 the following implementing acts were also published, introducing forms for new types of permits for UK nationals and their family members:

  • Regulation of the Minister of the Interior and Administration on applications and documents regarding the right of permanent residence in the territory of the Republic of Poland of citizens of the United Kingdom of Great Britain and Northern Ireland and their family members,
  • Regulation of the Minister of the Interior and Administration on applications and documents regarding the right of residence in the territory of the Republic of Poland of citizens of the United Kingdom of Great Britain and Northern Ireland and their family members,
  • Regulation of the Minister of the Interior and Administration on the certificate confirming the submission of certain applications by citizens of the United Kingdom of Great Britain and Northern Ireland and their family members

The provisions regulate the rules of entry and residence of UK nationals, their family members and others covered by the Withdrawal Agreement after a transitional period that ended on 31 December 2020. New legal solutions entered into force on January 1st, 2021.
