New regulations relating to changes in the working conditions of foreigners due to the COVID-19

On 16.05.2020 further changes in the law came into force, among others, concerning the changes in working conditions of foreigners due to COVID-19.

The regulations allow foreigners to perform work under conditions other than those specified in the following:

  • temporary residence and work permits,
  • temporary residence permits for the purpose of highly qualified employment,
  • work permits,
  • seasonal work permits,
  • declarations on entrusting work to a foreigner entered in the register of declarations,
  • temporary residence permits for the purpose of intra-corporate transfers (ICT),
  • temporary residence permits for the mobility of a long-term manager, specialist or trainee in the framework of an intra-corporate transfer (mobile-ICT),
  • documents attached to notifications about the intention of foreigners to take advantage of the short-term mobility of a manager, specialist or trainee, as part of an intra-company transfer,

- without having to obtain new permits, change them or enter new statements in the records.

The introduction of such changes in the law enables the entities entrusting foreigners to work to take full advantage of the solutions of the Anti-Crisis Act allowing for the modification of working conditions, in particular through the reduction of working time and reduction of remuneration or referral to remote work. Thanks to this solution, employers will be able to take full advantage of these instruments for the protection of workplaces also in case of employing foreigners. It will not be necessary to initiate any administrative proceedings.

Access to seasonal work was also made possible for foreigners who in the period after 13 March 2020 had access to the Polish labour market (based on the work permit, seasonal work permit, the extension of work permit, the extension of seasonal work permit or a declaration on entrusting work to a foreigner).
