- Register a declaration of assignment of work for the foreign national or obtain a seasonal work permit or a standard work permit.
Remember that a declaration of assignment of work can be registered for a maximum period of 24 months. After this period, it is necessary to apply for a work permit or submit an application for temporary residence and work, provided the foreign national has legal residence in Poland.
Before the foreign national starts working:
- check the document that legalizes their stay in Poland and keep a copy of that residence document;
- sign an employment or civil law contract with the foreign national that is consistent with the conditions specified in the permit or declaration, no later than on the day they start work;
- present the foreign national with a translation of the contract in a language they understand;
- submit a copy or scan of the contract with the foreign national to the relevant authority;
- if you already have a work permit or a declaration of assignment of work, send it to the foreign national abroad — these documents are necessary when applying for a national work visa (type D) at the Polish consulate in the foreign national’s home country.
A work permit is issued based on specific employment conditions.
The foreign national may perform work only under the terms specified in the permit. If they want to work for another or an additional employer, it is necessary to register a new declaration of assignment of work or obtain a separate work permit.
