Check whether you need a work permit for your employee

When employing a foreigner in Poland, you need a valid document legalizing their employment. However, in some cases a work permit is not required – check whether your employee:

  • is a citizen of Ukraine and is legally staying in Poland,
  • is a full-time student,
  • is a graduate of full-time higher education studies at a Polish university,
  • is a graduate of a secondary school in the Republic of Poland
  • holds a doctoral degree awarded by an institution authorized to confer doctoral degrees operating within the Polish higher education and science system, 
  • is a doctoral student at a doctoral school run by an entity based in the territory of the Republic of Poland,
  • is a citizen of Armenia, Belarus, Moldova or Ukraine performing work outside the scope of activities for which seasonal work permits are issued, for a period not exceeding 24 months, provided that the district labour office entered the employer’s declaration on entrusting work to a foreigner into the declaration register before the foreigner started work, the start date indicated in the declaration occurs no later than 6 months from the date of submission of the declaration, and the foreigner’s remuneration is not lower than that of employees performing comparable work or working in a comparable position,
  • holds a valid Pole’s Card

Check whether your employee:

  1. has refugee status granted in the Republic of Poland
  2. has been granted subsidiary protection in the Republic of Poland
  3. holds a permanent residence permit in the Republic of Poland
  4. holds an EU long-term resident permit in the Republic of Poland,
  5. has permission to stay for humanitarian reasons
  6. has tolerated stay permission in the Republic of Poland
  7. benefits from subsidiary or temporary protection in the Republic of Poland
  8. holds a valid certificate issued pursuant to Article 35(1) of the Act of 13 June 2003 on granting protection to foreigners within the territory of the Republic of Poland
  9. is a citizen of the European Union, the EEA or Switzerland 
  10. accompanies an EU, EEA or Swiss citizen in the territory of the Republic of Poland as an EU citizen’s family member 
  11. is an EU citizen’s family member who is not an EU citizen but has the right of residence in the territory of the Republic of Poland 
  12. holds a temporary residence and work permit, an EU Blue Card, a temporary residence permit for work performed by a foreigner delegated by a foreign employer or a temporary residence permit related to conducting business activity – under the conditions specified in that permit
  13. stays in the territory of the Republic of Poland in connection with mobility or an intra-corporate transfer 
  14. holds a temporary residence permit in the Republic of Poland granted for studies, scientific research, for the purpose of family reunification, for victims of human trafficking, a temporary residence permit due to EU long-term resident status in another Member State, or special rights for Turkish citizens 
  15. is the spouse of a Polish citizen or a foreigner referred to in points 1–7 and holds a temporary residence permit in the territory of the Republic of Poland granted in connection with marriage
  16. is a descendant of a Polish citizen or a foreigner referred to in points 1–7 holding a temporary residence permit in the territory of the Republic of Poland
  17. holds a temporary residence permit in the territory of the Republic of Poland granted for beneficiaries of mobility and their families
  18. stays in the territory of the Republic of Poland pursuant to Article 108(1)(2) or Article 206(1)(2) of the Act of 12 December 2013 on foreigners, or on the basis of a stamp placed in the travel document confirming the submission of an application for an EU long-term resident permit, if immediately before submitting the application they met the conditions referred to in points 14–17 
  19. is entitled to stay in the territory of another European Economic Area state and employed under an employment relationship in accordance with the regulations in force in that state, normally performing work in that state, and has been temporarily delegated by that employer to provide services in the territory of the Republic of Poland,
  20. is covered by international agreements or separate regulations allowing work without the necessity of holding a permit

Foreigners exempt from the obligation to hold a work permit also include

  • persons participating in the preparation or supervision of programs implemented under European Union actions or other international aid programs, or conducting training concerning such programs;

  • foreign language teachers working in kindergartens, schools, accredited teacher training institutions or colleges of social service workers referred to in the Act of 14 December 2016 – Education Law;

  • members of the armed forces of a NATO member state or their civilian personnel, working within international military structures located in the territory of the Republic of Poland or delegated to the territory of the Republic of Poland for the implementation of an armament program carried out under an agreement to which the Republic of Poland is a party;

  • persons conducting professional journalistic activities as foreign correspondents accredited by the Ministry of Foreign Affairs;

  • persons participating in the performance or preparation of a musical, musical-literary, stage, stage-musical, choreographic or pantomime work, or in the creation or production of an audiovisual work – up to 30 days in a calendar year;

  • persons delivering occasional lectures, speeches or presentations for up to 30 days in a calendar year;

  • athletes performing work for a sports club based in the territory of the Republic of Poland for up to 30 days in a calendar year;

  • persons performing work directly related to an international sports event as persons delegated to that event by an international sports organization, foreign sports association or foreign sports club;

  • clergy, members of religious orders or other persons performing work related to their religious function in churches and religious associations whose status is regulated by an international agreement or statute, or operating on the basis of entry in the register of churches and other religious associations, within a legal entity or other organizational unit of a church or religious association, or another entity on the basis of referral by the competent authority or legal entity of the church or religious association referred to above, or within a national interchurch organization with legal personality;

  • full-time students studying in the Republic of Poland at an institution approved by the minister responsible for internal affairs for admitting foreigners for studies pursuant to Article 144(4) of the Act of 12 December 2013 on foreigners (Journal of Laws of 2025, item 1079), unless the institution is exempt from approval, or which is exempt from approval pursuant to Article 144(5) of the Act and no decision prohibiting the admission of foreigners referred to in Article 144a(1) of that Act has been issued against it;

  • students performing work as part of an internship provided for in the study program at a university belonging to the Polish higher education and science system;

  • school pupils performing work as part of vocational training provided for in the curriculum of a secondary school belonging to the Polish education system;

  • juveniles employed under an employment contract for vocational preparation;

  • persons performing work under an EU education and training program;

  • persons performing work as part of an internship or traineeship organized in cooperation with an international student organization;

  • persons holding a visa issued for participation in a cultural or educational exchange program, humanitarian aid program or working holiday program regulated by an international agreement to which the Republic of Poland is a party, and performing work under that program;

  • participants of a government business internship program addressed to Polish diaspora communities;

  • persons holding a temporary residence permit for volunteers and performing work within the European Voluntary Service program;

  • persons performing work as scientific or research-technical staff in research institutes referred to in the provisions on research institutes;

  • persons delegated to the territory of the Republic of Poland by a foreign employer, provided that they maintain their permanent place of residence abroad, for a period not exceeding 3 months in a calendar year, for the purpose of:

    • performing assembly or maintenance works on technologically complete equipment, structures, machinery or other devices, if the foreign employer is their manufacturer,

    • accepting ordered equipment, machinery, other devices or parts manufactured by a Polish entrepreneur,

    • training employees of a Polish employer who is the recipient of the equipment, structures, machinery or other devices referred to above in their operation or use,

    • assembly and dismantling of exhibition stands and supervision thereof, if the exhibitor is a foreign employer delegating them for this purpose

  • persons performing work for Members of the European Parliament in connection with their function

  • persons authorized under legal acts issued by bodies established under the Agreement establishing an association between the European Economic Community and Turkey, signed in Ankara on 12 September 1963 (OJ EC L 217 of 29.12.1964, p. 3687; OJ EU Polish special edition, chapter 11, vol. 11, p. 10).

  • persons holding a valid visa issued for humanitarian reasons, state interest or international obligations, performing the profession of doctor or dentist and having the right to practice under the provisions of the Act of 5 December 1996 on the professions of doctor and dentist;

  • persons practicing as nurses or midwives and having the right to practice granted or confirmed under the provisions of the Act of 15 July 2011 on the professions of nurse and midwife;

  • persons practicing as paramedics and having the right to practice under the provisions of the Act of 1 December 2022 on the profession of paramedic and the self-government of paramedics;

  • persons practicing as physiotherapists and having the right to practice under the provisions of the Act of 25 September 2015 on the profession of physiotherapist;

  • persons practicing as pharmacists and having the right to practice under the provisions of the Act of 10 December 2020 on the profession of pharmacist;

  • persons performing work in the private domestic service of a member of a diplomatic mission or consular office of a foreign state or another person treated equally to a member of a diplomatic mission or consular office under statutes, international agreements or generally established international customs.

If none of the above applies to your employee – submit an application for a work permit.

When should the application be submitted?

The application must be submitted if you intend to employ a foreigner who is not exempt from the obligation to hold a work permit.

How to submit the application?

 only and exclusively electronically, via the portal praca.gov.pl 

A complete set of documents must be submitted with each application.
The Voivode may request documents confirming compliance with the requirements referred to in Articles 4 and 5 of the Act on the conditions of admissibility of entrusting work to foreigners, as well as originals of documents submitted with the application.

Documents prepared in a foreign language, except for travel documents, must be submitted together with their translation into Polish made by a sworn translator entered on the list of sworn translators maintained by the Minister of Justice.

The application should be addressed to the Voivode competent for the registered office of the company or the permanent place of residence of a natural person / sole proprietor – valid as of the date of application submission.

What documents should be submitted?

Documents required to obtain a permit:

Work permit for a Polish entity entrusting work to a foreigner

You submit this work permit application (formerly TYPE A) when your employee will perform work in Poland and you conduct business activity within the territory of the Republic of Poland.

To obtain a work permit for a Polish entity entrusting work to a foreigner, you must submit:

  • an application for the issuance of a work permit completed in accordance with the instructions and signed by a person authorized to represent the employer via the praca.gov.pl  portal;
  • a statement by the entity entrusting work as to whether it has been legally convicted for misdemeanors;
  • a document confirming payment of the application fee, specifying in the transaction title the first and last name of the foreigner concerned by the application;
  • a digital copy of all completed pages of the foreigner’s valid travel document containing the personal data of the foreigner concerned by the application;
  • documents confirming fulfillment of qualification requirements and other conditions necessary to perform work in a regulated profession, as well as other documents confirming fulfillment of requirements specified in separate regulations that may affect the outcome of the proceedings;

  • a document prepared by the user employer confirming arrangements regarding the assignment of the foreigner by a temporary work agency – if the entity entrusting the work is such agency;

An up-to-date and signed document prepared by the user employer confirming the assignment of the foreigner by the Temporary Employment Agency for temporary work for the benefit of the User Employer must be submitted, including the type of work, anticipated period of temporary work, working time of the temporary employee, place of work, remuneration for temporary work, number of job vacancies offered, and the position together with a valid agreement.

  • documents confirming the circumstances specified in the work permit application and circumstances justifying the issuance of the work permit, e.g. documents confirming the possibility of entrusting work to the foreigner and conducting business activity at the address specified in the application;

  • a power of attorney for the person submitting the application (template available for download) signed electronically by:

    • the business owner (in the case of a sole proprietorship),

    • persons authorized to represent the company, in accordance with the method described in Section II of the entity’s entry in the National Court Register (KRS) (in the case of a legal entity).

Work permit related to performing a specific function

You submit this work permit application (formerly TYPE B) when the foreigner performs the function of:

  • a member of the management board of a legal entity entered in the register of entrepreneurs of the National Court Register (KRS) or a member of the management board of a company in organization;
  • a person managing the affairs of a limited partnership or limited joint-stock partnership or representing such partnership;
  • a proxy (commercial representative).

To obtain a work permit related to performing a specific function, you must submit:

  • an application for the issuance of a work permit completed in accordance with the instructions and signed by a person authorized to represent the employer via the praca.gov.pl  portal
  • a statement by the entity entrusting work as to whether it has been legally convicted for misdemeanors
  • a document confirming payment of the application fee, specifying in the transaction title the first and last name of the foreigner concerned by the application
  • a digital copy of all completed pages of the foreigner’s valid travel document containing the personal data of the foreigner concerned by the application;
  • the company agreement — if the entity entrusting work to the foreigner is a limited liability company in organization, or copies of notarial deeds establishing the company — if the entity entrusting work to the foreigner is a joint-stock company in organization
  • a digital copy of the declaration on the amount of income earned or loss incurred by the entity entrusting work to the foreigner, being a corporate income taxpayer, for the tax year preceding submission of the application, together with confirmation of submission to the Tax Office;
  • documents confirming the employment status in the year preceding submission of the application;
  • documents confirming employment for an indefinite period and on a full-time basis for at least one year preceding submission of the application of at least two employees who are not required to hold a work permit, together with documents confirming payment of social insurance contributions for the above period;
  • documents confirming the circumstances specified in the work permit application and circumstances justifying issuance of the work permit;
  •  documents confirming possession of funds or carrying out activities enabling future fulfillment of the conditions specified in Article 36(2)(1) of the Act on the conditions of admissibility of entrusting work to foreigners in the territory of the Republic of Poland, in particular through activities contributing to investment growth, technology transfer, introduction of beneficial innovations or job creation (if the conditions specified in Article 36(2)(1) and (2) are not met);
  • a power of attorney for the person submitting the application (template available for download) signed electronically by:

    • the business owner (in the case of a sole proprietorship),

    • persons authorized to represent the company, in accordance with the method described in Section II of the entity’s entry in the National Court Register (KRS) (in the case of a legal entity).

An entity entrusting work to a foreigner and applying simultaneously for permits for more than one foreigner may attach one copy of the above-mentioned documents to the submitted applications.
The Voivode may request documents confirming compliance with the requirements referred to in Articles 4 and 5 of the Act on the conditions of admissibility of entrusting work to foreigners, as well as originals of documents submitted with the application.

Work permit in connection with the posting (secondment) of a foreigner by a foreign entity to the territory of the Republic of Poland

This permit is issued when a foreigner is employed by a foreign entity, performs work outside the territory of the Republic of Poland but on the territory of the Republic of Poland for that entity, and will be posted to work on the territory of the Republic of Poland:

1) to a branch, establishment or representative office of the foreign entity, or to an entity remaining in a relationship of dominance or dependence with the foreign entity, or in an affiliation relationship within the meaning of Article 4 § 1 points 4 and 5 of the Act of 15 September 2000 — Commercial Companies Code (Journal of Laws of 2024, item 18 and 96);

2) for the purpose of performing an export service by the foreign entity;

3) for a purpose other than that indicated in point 1 and other than the provision of services.

(formerly TYPES C, D, E).

To obtain a work permit in connection with the posting of a foreigner by a foreign entity to the territory of the Republic of Poland, you must submit:

  • an application for a work permit completed in accordance with the instructions and signed by a person authorized to represent the employer via the portal praca.gov.pl 
  • a statement from the entity entrusting work as to whether it has been lawfully punished for offences
  • a document confirming payment of the application fee, specifying in the transfer title the first and last name of the foreigner to whom the application relates;
  • a digital copy of all completed pages of the valid travel document of the foreigner containing the foreigner’s personal data to whom the application relates;
  • signed electronically by the foreign employer, a power of attorney for a person staying on the territory of the Republic of Poland who acts on behalf of the applicant and is authorized to represent them before the voivode and other authorities referred to in Article 17(1)(9) of the Act on the Conditions of Admissibility of Entrusting Work to Foreigners on the Territory of the Republic of Poland;
  • an up-to-date document from the relevant register confirming the legal status and form or nature of the activity conducted by the foreign employer and indicating who is authorized to represent the entity;
  • documents confirming the employment of the foreigner by the foreign employer and the performance of work by the foreigner outside the territory of the Republic of Poland for that entity, as well as documents confirming the posting of the foreigner to work in Poland;
  • documents confirming the relationships referred to in Article 40(1)(1) of the Act on the Conditions of Admissibility of Entrusting Work to Foreigners — if the application concerns a foreigner posted by a foreign entity to a branch, establishment or representative office, or to an entity affiliated with the foreign entity;
  • a contract under which the service in the territory of the Republic of Poland is or will be provided — if the application concerns a foreigner posted by a foreign entity for the purpose of performing an export service;
  • documents confirming the circumstances of posting — if the application concerns a foreigner posted by a foreign entity for a purpose other than the provision of services and posting to an affiliated entity;
  • documents confirming the circumstances referred to in Article 41 of the Act on the Conditions of Admissibility of Entrusting Work to Foreigners on the Territory of the Republic of Poland;
  • documents confirming fulfillment of qualification requirements and other conditions — in the case of intending to assign work to a foreigner in a regulated profession;
  • a declaration that the employer has financial resources or sources of income necessary to cover obligations resulting from entrusting work to a foreigner;
  • a power of attorney for the person submitting the application (download template) electronically signed by:

    • the owner of the company (in the case of a sole proprietorship),

    • persons authorized to represent the company, in accordance with the method described in section II of the entry of the entity in the National Court Register (KRS) (in the case of a legal entity).

An entity entrusting work to a foreigner applying for permits for more than one foreigner at the same time may attach one copy of the above-mentioned documents to the applications.

If documents submitted with the application are in a foreign language, a Polish translation prepared by a sworn translator is also required.

The voivode may request documents confirming compliance with the requirements referred to in Articles 4 and 5 of the Act on the Conditions of Admissibility of Entrusting Work to Foreigners, as well as originals of the documents submitted with the application.

Work permit — fees for issuing the permit

The fee for issuing a work permit is:

200 PLN — if you intend to assign work to a foreigner for a period not exceeding 3 months

400 PLN — if you intend to assign work to a foreigner for a period exceeding 3 months

PAY ONLINE

800 PLN — if, as an entity entrusting work to a foreigner, you intend to post the foreigner to the territory of the Republic of Poland

The fee is paid for submitting the application and is non-refundable regardless of the outcome. The payment must be made separately for each application — remember to include the first and last name of the foreigner to whom the payment relates.

FAQ

How long will I wait for the permit to be issued?

Due to the large number of proceedings conducted simultaneously by the Departament for Foreigners at the Office of Wielkopolska Province, the proceedings for a work permit may last up to two months. This time limit may be extended if it is necessary to check the documents submitted.

Can I work without a work permit if I practice a profession which is included in the Governor's Regulation as being exempted from submitting the Labour Market Test?

No. Only the cases specified in the regulations allow to employ a foreigner without the need to obtain a work permit. Exemption from submitting the Labour Market Test is only a facilitation in obtaining a work permit.
