When should I apply?

You should apply for a temporary residence permit if you wish to stay in Poland for a period exceeding 3 months and your primary purpose of stay is work.

You should apply for a residence permit in person before your current legal status expires (i.e. before your visa or residence card expires).

The amendment to the Act on Foreigners introduces a special solution for those foreigners who submitted applications for temporary residence and work before 1st January 2021.

All foreigners who submitted applications for temporary residence and work before 01.01.2021 and whose cases have not been terminated by 29.01.2022, will receive a simplified temporary residence and work permit for a period of 2 years.

If you wish to stay longer, you can submit an application for a temporary residence permit.

Please note that you should apply for a residence permit not later than on the last day of your legal stay.

If you do not plan to apply for residence permit in Poland, remember that you are oblige to leave Poland before your legal stay entitlement expires.

If you plan to come to Poland for more than 12 months, first you should apply for a Schengen visa or a national visa.

We will send you a notice in which you will be requested to submit documents confirming your purpose of stay in Poland. In you still want to work in Poland, submit Annex No 1. Furthermore, you will also be required to submit the labour market test  or provide documents confirming you are exempted from the obligation to obtain it.
