Residence permit for a long-term resident of the EU

If you are in Poland:

illegally, or

  • for the purposes of study, vocational training or study, or
  • in connection with obtaining a residence permit for humanitarian reasons, a permit for tolerated stay, asylum or temporary protection, or in connection with applying for international protection or asylum, or
  • on the basis of a temporary residence permit due to circumstances requiring a short-term stay, or
  • on the basis of a local border traffic permit, or
  • if you are a worker posted by a service provider for the purpose of cross-border provision of services or a service provider providing cross-border services, or
  • if you are detained, placed in a guarded centre or in a detention centre for foreigners or you are subject to a preventive measure in the form of a prohibition on leaving the country, or you are serving a sentence of imprisonment or you are under temporary arrest, or
  • if you were obliged to return and the deadline for voluntary return specified in the decision obliging the foreigner to return has not expired yet or you are staying outside the territory of the Republic of Poland, or you did not provide fingerprints to issue a residence card, although you were obliged to do so.

No. This income will not be taken into account even if it has been taxed and the employer has paid health insurance contributions. During the examination of your application we will check whether you have worked legally for the last 3 years.

No. A stable and regular source of income is one that repeats at regular intervals, e.g. remuneration for work.

  • You must demonstrate that you have a stable regular income for the three years immediately preceding your application, or two years, if you are in Poland on the basis of a Blue Card.

  • Remember that as of the date of issuing the decision on the long-term resident's residence in the EU, you must also prove that you have such income.

If you document that your stays outside of Poland were related to:

  • performing professional duties for a Polish employer (delegations) or accompanying a spouse or a parent in such trips, or
  • a special personal situation requiring going outside the territory of Poland, if it did not last longer than 6 months, e.g. treatment, or
  • taking part in internships, classes conducted during the course of studies at a Polish university,

then despite exceeding the period when you could stay outside Poland, it will not be an obstacle to granting a permit.

If you are now staying in Poland on the basis of a temporary residence permit due to your studies and file an application for a long-term resident of the EU, the proceedings will not be initiated.

Remember also that in the future the period of stay in Poland due to studies will be counted only in half.

Yes, you can apply for long-term resident status, but we will investigate the reason for the employment gap and it could potentially lead to the denial of the permit.

Income should be stable and regular; therefore, we will examine your earnings on a monthly basis over a three-year timeframe.

The period of stay in Poland is inclusive:

  • the entire period of stay under the visa-free regime,
  • the entire period of stay based on a visa (with some exceptions),
  • the whole period of stay on the territory of Poland based on a temporary residence and work permit,
  • the whole period of stay based on the "EU Blue Card" granted in both Poland and any other EU Member State,
  • the entire period of stay on the territory of Poland in the course of proceedings for granting international protection if it exceeded 18 months,
  • half of the period of stay on the territory of Poland in the case of a stay granted based on a visa for studies, a temporary residence permit for studies or professional training.
