When should an application for a residence permit for a family member (of foreigner) who stays outside the territory of Poland be filed, and who can do it?

You can apply for a temporary residence permit on behalf of each family member who would like to reunite with you, but stays outside the territory of Poland, if you hold one of the entry and stay titles below:

  • a permanent residence permit,
  • a residence permit for long-term EU resident,
  • a refugee status,
  • a subsidiary protection,
  • at least for a period of 2 years on the basis of subsequent temporary residence permits, including immediately before submitting an application for a temporary residence permit for a family member - on the basis of a permit granted to him for a period of stay of not less than 1 year,
  • a temporary residence permit, to conduct scientific research,
  • a temporary residence permit granted for the purpose of conducting scientific research, if the foreigner has a residence permit referred to in art. 1 clause 2 lit. a Council Regulation No. 1030/2002, bearing the annotation "scientist", issued by another Member State of the European Union, if the agreement on the admission of a foreigner for the purpose of carrying out a research project concluded with the competent scientific unit of that country provides for conducting scientific research also in the territory of the Republic of Poland,
  • a temporary residence permit in order to perform work in a profession requiring high qualifications,
  • a temporary residence permit granted for the purpose of performing work under an intra-corporate transfer,
  • a temporary residence permit granted in order to use long-term mobility,
  • a residence permit for humanitarian reasons.

Written consent is required to submit an application on behalf of a family member residing outside Poland.

I have been a holder of a residence card for over a year. My wife came to Poland and she is going to apply for a residence permit on the basis of „a stay with family”. Will the annotation “access to the labour market” be placed in her residence card?

If this is your first temporary residence card, your wife will not have the annotation “access to the labour market” placed in her card. Such annotation can only be placed in her card, if you have been staying in Poland for at least 2 years, on the basis of consecutive temporary residence permits and, before you wife applies for her residence permit, you have been granted a residence permit for the period of a stay not shorter than 1 year.

I have a residence card/I applied for a residence card and I would like my family to come to Poland. How to legalise the stay of my husband/wife and children in Poland?

INTERNSHIP/VOLUNTEERING

I terminated my internship, but my temporary residence card is still valid – can I stay in Poland?

You are obliged to inform the appropriate province governor that granted the temporary residence permit, that the reasons for granting permit no longer apply, that you terminated your internship. Your residence permit will be revoked and your residence card will be annulled. You will be oblige to leave Poland within 30 days following the day, when the decision on revocation of the permit has become final. If you want to stay in Poland, and you are not entitled to stay in Poland on different basis (e.g. valid visa), apply for another temporary residence permit according to your purpose of stay before or during the proceedings on revocation of the permit.

Where can I check if the internship organizer that I have chosen is authorized to organize internships for foreigners?

The valid list of the authorised internship organisers is announced in the official journal of the minister competent for internal affairs.

How long will I have to wait to be granted the temporary residence permit for an intern?

The proceedings should be terminated within 60 days. The 60 days is counted from the day when application is complete. If the application is not accompanied by all of the necessary documents, the 60 days term is suspended until you submit all necessary documents to the ongoing proceedings.

For how long can be granted the temporary residence permit for an intern?

The temporary residence permit for an intern can be granted for the period necessary for execution of the contract, which is the basis for your internship, but no longer than for the period of 6 months. Subsequent permit can be granted only once and for the period necessary for execution of the contract regarding internship, but no longer than 6 months.

Can I start an internship in the company, which specializes in other field that the field of studies that I completed?

No. Internship should be adequate to the field and level of the completed or ongoing studies.

When can I apply for the temporary residence permit for an intern?

You can apply for the temporary residence permit for an intern if you graduated from university not later than within 2 years directly prior to submitting the application or if you are a student at the university located outside the European Union.
