You do not meet the basic condition of a 5-year stay in Poland, because the stay associated with studies is counted only in half. Therefore, if you submit an application, we will refuse to grant you a long-term resident's residence permit.
There are different grounds on which you can get them:
Both authorizations shall be issued for an unlimited period of time. A resident's residence card is valid for 5 years and a permanent residence card for 10 years.
The permit is indefinite. The decision does not state the expiry date of the permit, but the residence card is issued for 5 years. Within 5 years, you apply for a new residence card.
An application for a minor child must be submitted due to the stay with the parents. In this case, please remember that the funds from the parents' work are the main source of income for minor children, therefore the decision cannot be made until the parents legalize their stay and work in Poland.
An adult student / pupil should submit an application due to his / her education / studies. If an adult pupil / student depends on his parents financially, the permit may be granted after the parents have legalized their stay and work.
It depends on conditions under which the permit was granted (i.e. which provisions were indicated in your decision). If you were granted a residence permit for family reunification (article 159 paragraph 1 of the Act on Foreigners of 12 December 2013) you can work without the need to obtain an additional work permit. If you were granted a residence permit on the basis of the article 187 par. 8 of the Act on Foreigners, in order to take up legal employment in Poland, you need a work permit. The legal basis of your permit can be found in the first section of your decision. Here you can check who and in what circumstances can apply for a residence permit for ‘family reunification’.
If your child was born in Poland, first you need to contact the embassy/consular office of your country of origin, located in Poland, in order to obtain a travel document (passport) for him/her. Then, you have to apply for a residence permit for your child, (not later than on the last day of validity of the passport). Please note that such passports often have a very short validity periods (e.g. 7 days).
One-off social benefits, purpose-specific benefits, aids of social character, unemployment benefits, child-support benefits - the so-called ‘800+’ or financial assistance for holders of the Pole's Card DO NOT constitute stable and regular sources of income. Financial means obtained from the aforementioned benefits are not taken into account in the calculation of income required to be granted a residence permit.
Documents confirming stable and regular source of income to be enclosed to the application for a foreigner’s child, if the application was filed by the child’s mother who remains unemployed and is dependent on her husband, who is not the child’s legal guardian:
