Residence permit for a long-term resident of the EU

The permit is indefinite. The decision does not state the expiry date of the permit, but the residence card is issued for 5 years. Within 5 years, you apply for a new residence card.

An application for a minor child must be submitted due to the stay with the parents. In this case, please remember that the funds from the parents' work are the main source of income for minor children, therefore the decision cannot be made until the parents legalize their stay and work in Poland.

An adult student / pupil should submit an application due to his / her education / studies. If an adult pupil / student depends on his parents financially, the permit may be granted after the parents have legalized their stay and work.

It depends on conditions under which the permit was granted (i.e. which provisions were indicated in your decision). If you were granted a residence permit for family reunification (article 159 paragraph 1 of the Act on Foreigners of 12 December 2013) you can work without the need to obtain an additional work permit. If you were granted a residence permit on the basis of the article 187 par. 8 of the Act on Foreigners, in order to take up legal employment in Poland, you need a work permit. If your child was born in Poland, first you need to contact the embassy/consular office of your country of origin, located in Poland, in order to obtain a travel document (passport) for him/her. Then, you have to apply for a residence permit for your child, (not later than on the last day of validity of the passport). Please note that such passports often have a very short validity periods (e.g. 7 days).

One-off social benefits, purpose-specific benefits, aids of social character, unemployment benefits, child-support benefits  - the so-called ‘500+’ or financial assistance for holders of the Pole's Card DO NOT constitute stable and regular sources of income. Financial means obtained from the aforementioned benefits are not taken into account in the calculation of income required to be granted a residence permit.

Documents confirming stable and regular source of income to be enclosed to the application for a foreigner’s child, if the application was filed by the child’s mother who remains unemployed and is dependent on her husband, who is not the child’s legal guardian:

  • If the child’s mother is a spouse of a Polish citizen, no documents confirming having a stable and regular source of income are required.
  • If the mother is not a spouse of a Polish citizen, she should enclose documents confirming her husband’s income source (e.g. employment contract, certificate of employment, etc.). Remember that the income must be sufficient for each person in your household and must come from a legal source.

  • No. It is not necessary. However, under certain circumstances, if some documents  need further clarification, you might be asked to submit such a certificate.
  • Remember that the period of compulsory education, imposed by law,  refers to any child under the age of 18 who stays in the territory of Poland.

You can apply for a temporary residence permit on behalf of each family member who would like to reunite with you, but stays outside the territory of Poland, if you hold one of the entry and stay titles below:

  • a permanent residence permit,
  • a residence permit for long-term EU resident,
  • a refugee status,
  • a subsidiary protection,
  • at least for a period of 2 years on the basis of subsequent temporary residence permits, including immediately before submitting an application for a temporary residence permit for a family member - on the basis of a permit granted to him for a period of stay of not less than 1 year,
  • a temporary residence permit, to conduct scientific research,
  • a temporary residence permit granted for the purpose of conducting scientific research, if the foreigner has a residence permit referred to in art. 1 clause 2 lit. a Council Regulation No. 1030/2002, bearing the annotation "scientist", issued by another Member State of the European Union, if the agreement on the admission of a foreigner for the purpose of carrying out a research project concluded with the competent scientific unit of that country provides for conducting scientific research also in the territory of the Republic of Poland,
  • a temporary residence permit in order to perform work in a profession requiring high qualifications,
  • a temporary residence permit granted for the purpose of performing work under an intra-corporate transfer,
  • a temporary residence permit granted in order to use long-term mobility,
  • a residence permit for humanitarian reasons.

Written consent is required to submit an application on behalf of a family member residing outside Poland.

If this is your first temporary residence card, your wife will not have the annotation “access to the labour market” placed in her card. Such annotation can only be placed in her card, if you have been staying in Poland for at least 2 years, on the basis of consecutive temporary residence permits and, before you wife applies for her residence permit, you have been granted a residence permit for the period of a stay not shorter than 1 year.
