It is a document which your employer can obtain from a district job agency competent according to the place of your work. This document is a result of a test, which is sometimes carried out when a non-EU citizen applies for a job in order to check that there are no suitable candidates having the required qualifications already available on the labour market to fill the position.

Labour Market Test needs to be issued not earlier than 180 days before the work permit or residence permit application submission. Only an original document of Labour Market Test will be accepted.

If you fail to remove formal defects, your application will not be examined. Your application will not be considered, and your case will be deemed complete.

Every minor (child), who stays in Poland without parents or custodians, should be represented by a legal guardian appointed by a guardianship court.

Stay on the territory of Poland during the period of validity of the entry and stay entitlement like visa, temporary residence permit, permanent residence permit, long-term resident's EU residence permit.

Moreover, foreigners exempt from the visa requirement may enter and stay in Poland under the so-called visa-free travel. The conditions of entry and stay and the list of countries whose citizens are exempt from the visa requirement can be found HERE.

Futhermore, if you submit an application for legalization of your stay in Poland during the period of validity of one of the above-mentioned entry and stay entitlements, and the application fulfills all the formal requirements, your stay in Poland will also be legal until the final decision regarding residence permit is issued. The condition of legal stay, regardless of the entry and stay entitlement, is possession of a valid passport.

 

A document you need to submit when applying for a residence permit for a long-term resident of the EU.

It confirms your right to right to occupy the living premises, such as: 

  • a lease agreement, or
  • a municipal housing lease agreement, or
  • a deed of ownership of premises, or
  • a lending contract for premises (on condition that the lender is your descendant, ascendant, sibling, spouse or spouse's parent).

A document confirming the possibility of providing the invited foreigner with accommodation, such as: 

  • a lease agreement, or
  • a lending contract for premises, or
  • a deed of ownership of premises, or
  • a cooperative ownership right to the premises, or
  • an extract from the real estate property records.

The labour market access in Poland depends on the document that legalised your stay in Poland. If you have a visa that allows you to work, then you are allowed to work with a registered declaration of entrusting work to a foreigner or if you have a valid work permit. Your work conditions must be as stated in the mentioned documents when regarding: employer, position, salary range, the type of employment contract you signed, working hours. If you’ve been granted the residence and work permit, you can work on conditions stated in the permit. In particular cases, you have the right to apply for a change of permit. If you’ve been granted a residence and work permit, in which condition of work and the actual employer is not stated, it means that you have free labour market access. Other permits that give free labour market access are temporary residence permit for family members, temporary residence permit for studies, permanent residence permit, long-term resident’s EU residence permit.

Travel document called "he list of travellers for trips within the European Union" is a list of pupils that must be presented at the time of crossing the border, during a school trip organized by Polish schools with the participation of foreigners from third countries. Such a list, prepared by the school principal and approved by the competent Governor, will be considered as a valid travel document in all European Union Member States if it meets the conditions set out in the regulations.

List of suggested documents for UK nationals to confirm that you meet the conditions of stay exceeding 3 months

If you are a worker, have a job offer or you are a self-employed person:

  • work contract or letter confirming employment and evidence that the employer is genuine or a document confirming that you have been offered a position, issued not longer that a month prior the application date
  • written statement confirming registration with the National Court Register (KRS) oraz Central Register and Information on Economic Activity (CEIDG)  or other evidence of your business activity

If you are a student or have a vocational training:

  • letter or certificate from your school, college, university or other accredited educational or training organisation showing the dates you enrolled, attended and completed your course - issued not longer that a month prior the application date,
  • document confirming comprehensive sickness insurance
  • document confirming that you have enough money to live on such as a bank statement or account summary

If you are a spouse of a Polish citizen:

  • marriage certificate, issued not longer that 3 months prior the application date,
  • your spouse' identity document (a certified copy)

If you are a self-sufficient person:

  • document confirming comprehensive sickness insurance
  • document confirming that you have enough money to live on such as a bank statement or account summary

If you are a UK national and joining a UK national as a family member:

  • a copy of registration certifcate of your UK family member you are joining
  • evidence of your relationship with your family member
  • spouse - marriage certificate, issued not longer that 3 months prior the application date
  • child – birth certificate
  • parent – birth certificate of the family member you are joining and a proof of self-sufficiency

The UK nationals' family members who were dependents of UK nationals before the end the transition period, retain their rights even after they are no longer dependent.

Depending on your place of residence, your application will be examined by a Governor from a given region (Province). The same local authority rule would apply to most applications and institutions you will need to contact. If your employer applies for a work permit, he needs to contact the local Governor based on the location of their registered office.

It is a temporary residence permit, that may be issued if you have a residence title issued by another EU country with annotation "ICT". You have to work in Poland as a part of a management team, as a specialist, or a trainee employee in a department or representation of the parent employer, whose headquarters are located outside of the EU for a period longer than 90 days.
